Terms of Service

These terms are subject to change. Please read them carefully.
1. Acceptance of Terms
These Terms of Service (“Terms”) form a legally binding agreement between you and Burg Social, Inc. (“Burg Social,” “we,” or “us”), the operator of the Burg mobile application (“Burg”), governing your use of Burg, the Burg Social website (burgsocial.com), and related services (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is initially offered with a focus on Vermont, United States, on a statewide basis, and may reference Vermont venues, events, and locations. We may expand availability to additional regions over time. Unless we state otherwise, these Terms apply wherever the Service is offered.
2. Eligibility
2.1 Minimum Age. Burg currently requires users to be at least 18 years old to use the Service.
2.2 Date of Birth and Age Verification. You must provide your accurate date of birth during onboarding; providing a false date of birth violates these Terms. Burg Social uses date of birth to determine your eligibility to use the Service and to apply age-restricted features such as Section 2.3. Burg Social may use identity or age verification to help confirm eligibility, and information confirmed through that process may supersede the date of birth you originally provided. If Burg Social determines that you do not currently meet the minimum age described in Section 2.1, your access to the Service may be restricted until you become eligible. 2.3 21+ Surfaces. Nightlife, bar, and alcohol-related areas of the Service are restricted to users 21 or older. By accessing those surfaces, you confirm you meet the age requirement.
3. Account Security
You are responsible for all activity under your account. You agree to keep your credentials confidential, notify us immediately at support@burgsocial.com if your account is compromised, not share your account, and not create duplicate accounts without permission. Burg Social is not liable for losses caused by your failure to protect your credentials.
4. User Content
4.1 Ownership and License. You retain ownership of content you create (“User Content”). By posting User Content you grant Burg Social a non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, display, distribute, and create derivative works of your content solely to operate, maintain, improve, and promote the Service.
4.2 Public Content. Posts, place posts, event titles and descriptions, profile display names, bios, and group content may be visible to other users or to the public depending on your settings. You decide what to share publicly. The order in which content appears may be personalized based on your interactions with the Service. Personalization affects ranking only and does not change what content you are eligible to see. See our Privacy Policy for details.
4.3 Content Retention. Posts, including normal posts, place posts, and Burg Group posts, may appear in the Home feed and on the dedicated place and group post surfaces for up to one week after they are created. Leaving those surfaces does not delete a post. A post remains in the post history on its creator’s profile, and remains available to anyone who saved it, until the creator deletes it. Posts are not automatically deleted solely because of their age. You may delete your own posts at any time; deleting a post also deletes its associated comments, removes it from your profile post history, and removes it from the Saved area of every user who saved it. Burg Social may also remove content through moderation, account deletion, or a legal or safety process, as described in these Terms and our Privacy Policy.
4.4 Saved Content. You can save venues, events, and posts to your Saved area. Saving creates a private reference to the original item; it does not create your own copy of it and does not give you any additional rights to it. A saved post normally stays in your Saved area until you unsave it or the person who created the post deletes it. Saving a post does not keep it in the Home feed, does not override the post creator’s audience or privacy settings, and does not prevent removal through moderation, account deletion, or a legal or safety process. If an item becomes unavailable to you for any of those reasons, it will no longer appear in your Saved area.
4.5 Content Standards. User Content must not: be false or fraudulent; infringe third-party intellectual property, privacy, or other rights; contain sexually explicit material; promote or depict violence, hate speech, or discrimination; facilitate grooming or exploitation of minors; advertise illegal products or services; impersonate others; or violate applicable law.
4.6 Moderation. Burg Social reserves the right - but not the obligation - to review, remove, or restrict any User Content at any time without notice. Moderation actions do not create a duty to monitor content, prevent harm, or take any specific action in any case.
5. Private Messages
Messaging features (direct messages, message requests, group chats) are treated as private communications protected by reasonable security safeguards. Private messages are not end-to-end encrypted by default. Burg Social may access message content where required by law, to enforce these Terms, or in response to valid legal process. Do not use messaging for communications you require to remain absolutely confidential.
When you delete a message or conversation, it is removed from your view. Copies delivered to other participants may remain in their message threads, devices, or backups. See our Privacy Policy for details on message retention.
6. Prohibited Conduct
You agree not to: gain unauthorized access to any account, system, or network; scrape or harvest user data; use bots or automated tools; interfere with Service integrity or availability; circumvent security features; send spam or phishing communications; stalk, harass, or harm any person; facilitate illegal activity; or attempt to reverse-engineer the Service.
7. In-Person Interactions, Events, and Assumption of Risk
Please read this section carefully. It explains, in plain language, that Burg, the service created by Burg Social, Inc., is a technology platform that helps you discover people, events, groups, businesses, venues, places, and plans - and that when you choose to meet someone, attend something, or go somewhere you found through Burg, that choice, and the risks that come with it, are yours.
7.1 Burg Social’s Platform Role. Burg Social provides technology and information tools for creating, discovering, and communicating about user-created events (“Community Events”), events published through user-run groups (“Group Events”), user-run groups (“Burg Groups”), and other people, businesses, venues, places, and plans. Unless Burg Social expressly states otherwise in writing for a specific officially designated Burg Social event or activity, Burg Social: is not the organizer, host, or sponsor of any event or activity; is not the operator of any venue or business; is not the owner or manager of any property; is not the employer, agent, partner, joint venturer, or representative of any organizer, group leader, venue, business, or user; does not supervise, manage, or control attendance or participant conduct; does not provide transportation; does not provide security, medical services, or emergency services; does not inspect locations, activities, or equipment; and is not a party to arrangements, agreements, or transactions users make with one another or with third parties.
7.2 Activities This Section Covers. This section applies to all real-world interactions and activities discovered, created, discussed, or coordinated through the Service, including: meetings between users; Community Events, Group Events, and other user-created events; third-party events; visits to restaurants, bars, nightlife locations, cafés, businesses, venues, public places, or private property; group outings; transportation arrangements; activities organized through messages, chats, or group chats; and any other real-world plan connected to the Service.
7.3 Your Participation Is Voluntary and Is Your Decision. Your decision to meet another person, attend an event, visit a business or location, or participate in any activity discovered or coordinated through Burg is your independent and voluntary decision. The appearance of a person, event, group, business, venue, place, or plan in the Service is not an instruction, invitation, or recommendation from Burg Social to attend or participate. Saving, joining, following, messaging, or RSVPing does not obligate you to attend, and you may decline, leave, or stop participating at any time. You alone are responsible for using your own judgment to decide whether an activity is suitable for you, including evaluating the people, organizers, places, activities, transportation, conditions, your own physical ability and equipment, and other risks involved before participating.
7.4 Assumption of Risk. In-person interactions and real-world activities can involve foreseeable and unforeseeable risks. Depending on the activity, these risks may include, without limitation: personal injury; illness; death; unsafe locations or venue conditions; dangerous activities; transportation incidents; alcohol- or substance-related conduct; theft; property damage; harassment; assault; sexual misconduct; other criminal conduct; discrimination; deception or misrepresentation; financial disputes; crowd conditions; weather; equipment failure; accessibility barriers; food or allergen exposure; and acts or omissions of organizers, attendees, businesses, venues, or other third parties. To the fullest extent permitted by applicable law, you knowingly and voluntarily assume the risks arising from your decision to meet, attend, visit, or participate in any in-person interaction or activity described in this section. This assumption of risk applies to the conduct of users and third parties and to conditions Burg Social does not control; it does not require you to assume risks that applicable law does not permit to be allocated to you.
7.5 User and Third-Party Conduct; Disputes. Burg Social does not control and, to the fullest extent permitted by applicable law, is not responsible for the acts or omissions of users, event creators, event organizers, group leaders, group members, attendees, businesses, restaurants, bars, nightlife operators, venues, their employees and contractors, property owners, transportation providers, ticketing platforms, or other third parties. Each user, organizer, business, venue, and third party remains responsible for its own conduct, representations, compliance, property, services, and legal obligations. Disputes between users, or between a user and a venue, organizer, business, or other third party, generally must be resolved between those parties, subject to applicable law. Reporting a dispute to Burg Social does not guarantee intervention, reimbursement, content removal, or any particular outcome.
7.6 No Guarantee of Events, Listings, Venues, or People. Burg Social makes no guarantee that: an event will occur or occur as described; an organizer will appear; a venue will be open; a location is accurate; details remain current; an event or activity is lawful, safe, suitable, or accessible; attendance information is accurate; a person is who they claim to be; participants will behave appropriately or lawfully; a business or organizer carries insurance; a venue holds necessary permits or licenses; food or products are safe; or an event complies with alcohol, age, licensing, capacity, or other legal requirements. See Section 9 for third-party and venue information and Section 8 for what verification does and does not mean.
7.7 Organizer and Group Leader Responsibility. If you create a Community Event or Group Event, lead a Burg Group, or otherwise organize or host an activity, you - not Burg Social - are responsible for: the accuracy of event and activity information; lawful activity and compliance with applicable law; obtaining necessary permissions, venue authorization, permits, and licenses; carrying insurance where required; observing capacity limits; reasonable safety planning and emergency procedures; enforcing applicable age restrictions and alcohol compliance; the accuracy of accessibility representations; and communications with attendees. The presence of your event, group, or content on the Service does not mean Burg Social has confirmed that you satisfied any of these responsibilities. You agree to indemnify and hold harmless Burg Social from claims arising from your events, groups, or activities as described in Section 18.
7.8 Your Safety Responsibilities. Meeting people in person always carries risk. You should: review event and location details and confirm important information independently; use caution when meeting unfamiliar people; tell a trusted person where you are going when appropriate; meet in well-lit public places when appropriate; arrange safe, independent transportation; follow applicable laws; trust your instincts and leave any situation that feels unsafe; contact local emergency services when necessary; and report suspected violations through the reporting tools available in the Service. These are suggestions to help you make your own decisions - following them does not guarantee that harm will be avoided, and they are not a substitute for your own judgment. See our Safety Center for more guidance.
7.9 Safety Tools and Moderation Are Not Supervision. Burg Social may offer reporting, blocking, moderation, verification, account restrictions, safety guidance, content review, event removal, and emergency links or instructions. These tools do not constitute continuous monitoring of the Service or of any person, do not guarantee that harm will be prevented or that every violation will be detected, do not make Burg Social a supervisor or guarantor of in-person conduct, and do not replace emergency services or law enforcement. Burg Social retains the right - but except where required by law does not assume a duty - to investigate, restrict, remove content or accounts, cooperate with law enforcement, and take other protective action.
7.10 Age-Restricted Activities. You must comply with applicable age restrictions, including the 21+ requirements described in Section 2.3, and must not misrepresent your age. Event organizers, businesses, and venues remain responsible for enforcing legal and venue-specific age restrictions for their own events, premises, and activities, including alcohol and nightlife restrictions. Burg Social’s age gating and verification controls apply to the Service itself and do not guarantee that every participant, organizer, business, or venue complies with applicable age requirements.
7.11 Not an Emergency Service. Burg Social is not an emergency service. If you are in immediate danger or witness an emergency, contact your local emergency services (911 in the United States) first. Reporting something to Burg Social does not replace contacting emergency services, does not guarantee immediate review, does not guarantee that harm will be prevented, and does not obligate Burg Social to resolve an in-person emergency. Burg Social may cooperate with law enforcement and respond to valid legal process as described in these Terms and our Privacy Policy.
7.12 Related Provisions. The disclaimers in Section 16, the limitations of liability and release in Section 17, and the indemnification obligations in Section 18 apply to the in-person interactions and activities described in this section.
8. Verification and Verified Identity Information
8.1 What Verification Means. Burg Social may offer identity, age, or document verification facilitated through Didit or another third-party verification provider (“Verification Provider”). Verification means only that the user successfully completed the specific verification process offered by the applicable Verification Provider at that time. Verification is limited to the specific checks actually performed. Nothing more.
8.2 Verified Badges and Identity Information. After successful verification, Burg Social may display a verified badge on the user’s profile. Depending on current product support, settings, and rollout stage, Burg Social may also display verified identity/status indicators, verified name information, or similar trust-context labels. The exact display may vary over time. Any such display is informational only.
8.3 What Verification Does NOT Mean. Verification, verified badges, verified identity/status indicators, and verified name information do not mean that Burg Social has independently verified, warranted, guaranteed, or certified the user’s identity beyond the verified attributes; that Burg Social has performed a criminal-background check or any other background check (Burg Social does not perform background checks unless it expressly states in writing that it does); that the user is safe, trustworthy, honest, sober, qualified, law-abiding, free of criminal history, or suitable to meet; that Burg Social endorses the user or vouches for the user’s character; that the verified person will attend any event or appear in person; or that the user’s conduct will be lawful or appropriate. Verification is not a safety guarantee.
8.4 User Responsibility. You are solely responsible for your own safety decisions, regardless of any other user’s verification status, verified badge, or verified identity/status display. Verification does not transfer to Burg Social any responsibility for your decision to meet, attend, visit, or participate in any activity. See Section 7.
8.5 Access Without Verification. Verification is not required merely to browse or join eligible public Burg Groups, to browse eligible public Community Events or Group Events, or to RSVP to eligible public Events, where those features are available. Unverified users may also be eligible for limited Burg Group leadership, Event hosting, and Group Chat functionality, subject to lower account limits. Access without verification is not unrestricted. Age, location, privacy, moderation, blocking, safety, membership, eligibility, and other applicable rules continue to apply, and certain features - including creating Burg Groups or Events limited to verified people, creating Place Posts, locating verified users through certain people-search features, and sending friend requests to verified users - may require verification.
8.6 Verified-Only Audiences and Audience Changes. Where available, verified users may create Burg Groups, Community Events, or Group Events limited to verified people (“verified-only”), use Verified Only browsing preferences, and access higher leadership and Event-hosting limits and additional trust and audience controls. Verified users may still browse public content, create public Groups and Events, temporarily turn off a Verified Only browsing preference, and choose public audiences independently from their browsing preference. Events published through a Burg Group (“Group Events”) may be open to everyone, limited to verified people, or limited to members of the associated Group, as selected by an authorized organizer. A Group Event’s audience does not automatically inherit the Group’s own privacy or audience settings, and a verified-only or private Group may still publish a public Group Event; the Group’s own access rules continue to apply to the Group itself. If an authorized user changes an eligible Group or Event to a verified-only audience, memberships, co-leadership roles, or RSVPs associated with users who are not currently verified may be removed or canceled, and affected users and organizers may receive notice or summaries, subject to applicable settings, policies, and safety rules.
8.7 Verification Loss and Automatic Public Fallback. Verification may expire, be denied, be revoked, or otherwise become inactive. If your verification becomes inactive: verified-only Burg Groups you own and verified-only Community Events or Group Events you created may automatically become public, so that you keep access to your own content; Events limited to members of a Group remain limited to Group members; you may be removed from verified-only Groups you do not own; your access to verified-only content may end; and your account limits may change. This automatic public fallback may occur even if your verification status changes in error. Re-verification does not automatically restore prior audiences, memberships, or RSVPs. You are responsible for reviewing the audience settings of Groups you own and Events you created if your verification status changes.
9. Third-Party Providers, Venues, and Links
The Service may display venue, place, and map content from third-party sources such as OpenStreetMap-derived place data; Apple mapping services on iOS; Google Maps on Android; and other third-party place-data sources, including Google Places (“Provider Content”). Provider availability varies by platform and feature. Burg Social does not own, control, endorse, or guarantee the accuracy of Provider Content. The Service may link to third-party sites governed by their own terms and privacy policies. Burg Social is not responsible for third-party content or practices.
The Service may also display venue, business, place, event, hours, menu, policy, special, age restriction, cover charge, dress code, entertainment, website, phone, image, or other information from venue or business submissions, public sources, users, or Burg Social administrative review. Burg Social works to provide useful information, but we do not guarantee that venue, business, place, or event information displayed in the Service is complete, current, accurate, available, or error-free. You should confirm important details directly with the venue or organizer before relying on them. Burg Social is not a party to, and is not responsible for, purchases, reservations, tickets, or other transactions or arrangements you enter into with any venue, business, ticketing platform, or other third party.
12. Intellectual Property
The Service - including its design, software, features, logos, and trademarks - is owned by Burg Social, Inc. and is protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you ownership rights in the Service.
13. DMCA / Copyright
If you believe content on the Service infringes your copyright, please see our DMCA and Copyright Policy and submit a notice to copyright@burgsocial.com.
14. Suspension and Termination
Burg Social may suspend, restrict, or terminate your account at any time, with or without notice, for any reason, including violation of these Terms, illegal or harmful conduct, fraudulent activity, or safety concerns. Termination does not affect our right to retain data as described in the Privacy Policy or to pursue legal remedies.
15. Account Deletion
You may delete your account at any time through Profile -> Settings -> Account -> Delete account, or by contacting support@burgsocial.com. When you initiate deletion, your account is immediately hidden and disabled. After a 7-day deletion processing period, your account data is deleted or anonymized. You cannot access or restore the account through the current app during that period. Certain data may be retained for safety, legal, moderation, backup, or operational purposes as described in our Privacy Policy and Account Deletion Policy.
16. Disclaimers of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE OPERATION. BURG SOCIAL DOES NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY CONTENT, PROVIDER CONTENT, USER CONTENT, OR VERIFICATION RESULTS. BURG SOCIAL MAKES NO WARRANTY THAT ANY EVENT WILL OCCUR AS DESCRIBED, THAT ANY LISTING IS ACCURATE, THAT ANY PERSON IS WHO THEY CLAIM TO BE, OR THAT ANY IN-PERSON INTERACTION, EVENT, ACTIVITY, OR LOCATION WILL BE SAFE.
17. Limitation of Liability and Release
17.1 Excluded Damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BURG SOCIAL, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS (TOGETHER, THE “BURG SOCIAL PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
17.2 In-Person Interactions and Third-Party Conduct. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BURG SOCIAL AND THE BURG SOCIAL PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ACTS, OMISSIONS, CONDUCT, DISPUTES, INJURIES, DEATH, ILLNESS, PROPERTY DAMAGE OR LOSS, THEFT, CRIMES, HARASSMENT, ASSAULT, SEXUAL MISCONDUCT, TRANSPORTATION INCIDENTS, VENUE CONDITIONS, ALCOHOL- OR SUBSTANCE-RELATED CONDUCT, THIRD-PARTY PRODUCTS OR SERVICES, CANCELED, CHANGED, INACCURATE, OR UNSAFE EVENTS, OR OTHER HARM ARISING FROM OR RELATING TO IN-PERSON INTERACTIONS, EVENTS, ACTIVITIES, BUSINESSES, VENUES, PLACES, OR PLANS DISCOVERED, CREATED, COMMUNICATED, OR COORDINATED THROUGH THE SERVICE, INCLUDING MEETING ANOTHER USER, ATTENDING OR ATTEMPTING TO ATTEND AN EVENT, VISITING A BUSINESS, VENUE, OR OTHER PLACE, PARTICIPATING IN AN ACTIVITY, USER COMMUNICATIONS, AND ORGANIZER OR ATTENDEE CONDUCT, AS DESCRIBED IN SECTION 7.
17.3 Release. To the fullest extent permitted by applicable law, you release the Burg Social Parties from claims, demands, and damages of every kind, known or unknown, arising out of or relating to disputes between you and other users, or between you and third parties such as organizers, group leaders, businesses, venues, or transportation providers, including disputes arising from in-person interactions, events, or activities described in Section 7. This release covers the conduct of those users and third parties. It does not release any user or third party from responsibility for that party’s own conduct, and it does not release the Burg Social Parties from liability that cannot lawfully be excluded or limited.
17.4 Savings Clause. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing in these Terms is intended to waive, release, or limit any right or remedy that applicable law does not permit to be waived, released, or limited. Some jurisdictions do not allow certain warranty disclaimers, liability exclusions or limitations, releases, or risk allocations, so parts of Sections 7, 16, and 17 may not apply to you.
18. Indemnification
You agree to defend, indemnify, and hold harmless Burg Social, Inc. and its officers, directors, employees, agents, and licensors from claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from: your use of the Service; your User Content; your violation of these Terms; your violation of applicable law; events or activities you create, organize, host, or attend; Burg Groups you lead; invitations you extend; venue, property, or transportation arrangements you make; your interactions with other users; or any misrepresentation you make. This obligation applies only to claims reasonably connected to your own conduct, content, activity, or legal violations.
19. Dispute Resolution
19.1 Informal Resolution. Before filing any formal claim, contact Burg Social at legal@burgsocial.com and attempt informal resolution for at least 30 days.
19.2 Exceptions. Nothing herein prevents either party from seeking injunctive relief for intellectual property infringement or from filing a complaint with a government agency.
19.3 Disputes After Informal Resolution. If informal resolution does not resolve a dispute, either party may bring a claim in a court or other forum that has proper jurisdiction and venue, subject to applicable law. These Terms do not require arbitration unless Burg Social and the user separately agree in writing.
20. Changes to Terms
We may update these Terms. Material changes will be notified through the Service or by other means, and the “Last updated” date will be revised. Where we require it, you must affirmatively review and accept the updated Terms in the app before continuing to use the Service. Otherwise, continued use after the effective date constitutes acceptance.
