DMCA and Copyright Policy

Burg Social respects intellectual property rights and responds to copyright concerns. This policy describes how to report alleged copyright infringement and how we handle such reports.

1. Reporting Copyright Infringement (Takedown Notice)

If you believe that content on the Burg Social Service infringes your copyright, submit a written notice to our designated copyright agent at copyright@burgsocial.com.

Your notice should comply with 17 U.S.C. Section 512(c)(3) and include all of the following:

Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or, if multiple works are covered, a representative list.
Identification of the infringing material: A description of the material you claim is infringing and its location in the Service (for example, a URL or description sufficient for us to locate it).
Your contact information: Your name, address, telephone number, and email address.
Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Accuracy statement: A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Signature: Your physical or electronic signature.

Incomplete notices may not be processed. False notices may expose the submitter to liability for damages under 17 U.S.C. Section 512(f).

2. Counter-Notice

If you believe content you posted was removed in error, you may submit a counter-notice to copyright@burgsocial.com containing all of the following under 17 U.S.C. Section 512(g)(3):

Identification of the removed material: A description of the removed material and its location before removal.
Statement under penalty of perjury: A statement that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
Your contact information and consent: Your name, address, and telephone number; a statement that you consent to the jurisdiction of the federal court for the district in which your address is located (or, if outside the United States, a district in which Burg Social may be found); and a statement that you will accept service of process from the person who submitted the original takedown notice or their agent.
Signature: Your physical or electronic signature.

If we receive a valid counter-notice, we may restore the removed content not less than 10 and not more than 14 business days after receiving it, unless our designated agent first receives notice that the original complaining party has filed an action seeking a court order concerning the material.

3. Repeat Infringer Policy

Burg Social has a policy of terminating accounts of users who are determined to be repeat infringers of intellectual property rights, in appropriate circumstances and at Burg Social’s sole discretion.
